Real Property Sales
Sales are listed by date. Under the date you will find the address or legal description of the property being sold along with an abbreviated case heading, sale status, starting bid amount (if given) and purchaser information after the sale.
The creditor or representative may attend the sale or submit a written bid to the Sheriff's Office up to 48 hours before the sale. They are allowed to bid up to the amount they are owed plus the costs of the sale. When bids are submitted to the Sheriff's Office, known as a credit bid, you will see the amount in the sale status and the bid will start at that amount.
If you are attending the sale please check in at the Sheriff’s Office. If you are bidding at the sale, you be asked to verify that you have the funds to participate.
Only U.S. currency and/or certified cashier’s check(s) made payable to the Polk County Sheriff’s Office will be accepted at the time and location of the sale. Payment must be made in full immediately upon close of the sale.
If you need more information, there is a link to the OSSA website where you can see the notice of sale, writ of execution and judgment. Some of the future sales will not be posted on the OSSA website right away, but will be posted at least 28 days prior to the original sale date.
PROSPECTIVE BIDDERS, READ THIS SECTION CAREFULLY:
Before bidding at the sale, a prospective bidder should independently investigate:
(a) The priority of the lien or interest of the judgment creditor;
(b) Land use laws and regulations applicable to the property;
(c) Approved uses for the property;
(d) Limits on farming or forest practices on the property;
(e) Rights of neighboring property owners; and
(f) Environmental laws and regulations that affect the property.
